Client Services Agreement

This Client Services Agreement (the "Agreement") is made and entered into on this [date], by and between [Migration Hub], a registered migration agency represented by Mr. Tristan Podger, MARN 1679089 (the "Migration Agent"), and the client, [Client's Name], (the "Client"), collectively referred to as the "Parties."

1. Services to be Provided:

The Migration Agent agrees to provide professional migration agency services to the Client, including assistance with visa applications, review of refusals or cancellations, and representation at the Administrative Appeals Tribunal (AAT) for visa appeals.

2. Scope of Work:

The Migration Agent or his associates, under his careful purview, will perform the necessary work to process and submit visa applications, review refusal or cancellation cases, and represent the Client at the AAT, if required.

3. Fees and Payment:

The Client agrees to pay the Migration Agent the agreed-upon fee for the services rendered. The fee will be communicated and agreed upon separately in writing before the commencement of any work. The Client shall make the payment in full as per the agreed schedule.

4. Intellectual Property:

The Client acknowledges that any written or oral advice, guidance, documentation, or information provided by the Migration Agent in connection with the visa application, appeal, or any other matter shall remain the intellectual property of the Migration Agent. The Client agrees not to disclose, share, or distribute such intellectual property to any third party without the express written consent of the Migration Agent.

5. Refund Policy:

If, for any reason, the Client demands a refund after they have received the Migration Agent's intellectual property and services, the Migration Agent shall be entitled to charge the Client at a rate of $650 per hour, plus GST, for all work performed on the case, including written and oral (phone) advice, and any information provided to the Client.

6. Confidentiality:

The Parties agree to maintain the confidentiality of all information shared during the course of the engagement. The Migration Agent shall handle all client information in accordance with applicable privacy laws.

7. Termination:

Either Party may terminate this Agreement by providing written notice to the other Party. The Client may be entitled to a pro-rata refund of any fees paid for services not yet rendered if termination occurs before completion of the agreed-upon services.

8. Governing Law:

This Agreement shall be governed by and construed in accordance with the laws of [Queensland, Australia], without regard to its conflict of laws principles.

9. Entire Agreement:

This Agreement constitutes the entire understanding between the Parties and supersedes any prior agreements, written or oral, regarding the subject matter herein.
