Australian Partner visa (onshore or offshore)

Additional Information

The Australian partner visa is designed for individuals who are in a genuine and ongoing relationship with an Australian citizen, permanent resident, or eligible New Zealand citizen. This visa allows the applicant to enter and stay in Australia with their partner and eventually apply for permanent residency if certain requirements are met. There are two main types of partner visas:

  1. Subclass 820/801 (Onshore): This visa allows applicants who are in Australia to apply for a temporary visa (subclass 820) first, which allows them to live and work in Australia while their permanent visa (subclass 801) application is being processed.
  2. Subclass 309/100 (Offshore): If the applicant is outside Australia when they apply, they can opt for this visa. They will first be granted a temporary visa (subclass 309) to travel to Australia, and later, if eligible, a permanent visa (subclass 100) will be issued.

To be eligible for a partner visa, the applicant must prove that their relationship is genuine and ongoing, meet certain health and character requirements, and demonstrate that they have adequate financial support to settle in Australia. The application process can be complex and time-consuming, and it is essential to submit a comprehensive and accurate application to avoid delays or potential refusals.

Migration agencies specialize in assisting individuals and couples with their partner visa applications. Here's how they can help:

  1. Expert Advice: Migration agencies have experienced and knowledgeable professionals who are well-versed in Australian immigration laws and regulations. They can provide personalized advice based on the client's unique circumstances, ensuring they understand the requirements and potential challenges.
  2. Application Preparation: A migration agency can assist clients in gathering the necessary documents, completing the application forms, and ensuring that all supporting evidence is included. This includes proof of the genuine relationship, financial capacity, health, and character documents.
  3. Lodging the Application: Migration agencies can lodge the visa application on behalf of the client, ensuring that all the necessary information is correctly entered and the application is submitted to the relevant authorities.
  4. Communication and Follow-up: Throughout the application process, the migration agency can liaise with the Department of Home Affairs and other relevant authorities, keeping the client informed about the progress of their application.
  5. Managing Complex Cases: In some instances, certain factors in a partner visa application might make it more complex. A migration agency can handle such cases and provide additional guidance to overcome potential hurdles.
  6. Appeal and Review: If a partner visa application is refused, migration agencies can assist with appeals or review processes, helping clients to present a strong case for reconsideration.

It is important to note that while migration agencies can provide valuable assistance, they are not the decision-makers in the visa process. The Department of Home Affairs ultimately assesses and decides on visa applications based on the information provided. As such, it is essential for clients to be honest and transparent throughout the application process.

If you are considering applying for an Australian partner visa, it is recommended to seek assistance from a reputable migration agency with a proven track record of success in partner visa applications. Always ensure that the migration agency is registered with the appropriate authorities to provide immigration advice and services.
